Shisanyama Festival (PTY) Ltd is running a competition to find two men and two women to be the models in the promotional material for this year’s event.
Winners will each receive a Pavilion Shopping Centre voucher valued at R500, a bottle of Spiritual Vodka, a pair of VIP tickets to the Shisanyama Festival on 2 September at Eyadini Lounge, and participation as a model in the professional photoshoot at 3 Peace Road on Saturday 29 July.
All entrants to the competition must be available to attend the photoshoot.
The competition will start on the 29 June 2017 and ends 8am on Monday 16 July 2017.
The competition is conducted by the Shisanyama Festival (PTY) Ltd and its third-party contractors. No one who is a director, employee or agent of or consultant to the Shisanyama Festival (PTY) Ltd or who is a spouse, life partner, close family member, business partner, or associate to a director, employee or agent of or consultant to the Shisanyama Festival (PTY) Ltd may take part or enter the competition.
This competition is only open to legal residents of the South Africa aged 18 years or over. You must have a valid South African delivery address and ID when claiming a prize. Entry into this competition is regarded as acceptance of these terms and conditions.
How to enter
• To enter the competition, you must post a photo of yourself with a bottle of Spiritual Vodka clearly visible in the photograph, to any of the Shisanyama Festival social profiles – Facebook, Twitter or Instagram.
• Winners will be decided by Shisanyama Festival judges.
• The judge’s decision will be final and binding and no correspondence will be entered into.
• The winners will be announced on Monday 16 July via the Shisanyama Festival social profiles: Instagram, Twitter and Facebook.
By entering this competition you waiver all world-wide rights for the full period of such rights and all renewals and extensions thereof (to include electronic publishing), including copyright and full waiver, for all photographs taken of you by Shisanyama Festival (PTY) Ltd under this agreement is transferred to Shisanyama Festival (PTY) Ltd.
Winners grant permission for the Shisanyama Festival (PTY) Ltd to use their photographs in any advertising and promotional material for this competition.
Consumer Protection Act
Under the Consumer Protection Act (CPA), we need to keep records of all the people used to promote the Promotional Competition. We (or one of our subcontractors or affiliates) will keep this agreement for three years to serve as the record as required by the CPA.
No liability for Facebook
The competition is in no way sponsored, endorsed or administered by, or associated with Facebook. You release Facebook of all liability for any damage you may suffer. You will be giving information to us and not to Facebook.
Dispute resolution Arbitration
If there is any dispute, the parties must refer the dispute within 15 business days to arbitration (including any appeal against the arbitrator’s decision) under AFSA’s latest rules for expedited arbitrations.
CPA dispute resolution
Despite 10.1, any party may use other dispute resolution channels provided for by the CPA or other law.
This clause is separate and divisible from the rest of this agreement and stays effective even if this agreement ends or is invalid. Force Majeure Parties not liable. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.
If a party cannot fulfil its obligations, because of matters beyond its control, it must notify the other party in writing within 2 days so that they can discuss the way forward.
General Rules No liability
By taking part in this competition you agree that you will not hold the Shisanyama Festival (PTY) Ltd liable for any losses, harm, damages, injury, claims or actions related to this competition.
Changing the rules
These rules, including the duration of the competition, can only be reasonably changed (or superseded) by us in a written revision to these rules posted on the competition website or any other potential official competition communication methods we use to reach a majority of potential Participants.
South African laws govern this competition.
Use of personal information
Participants understand and agree that to offer the competition, the Shisanyama Festival (PTY) must collect and use personal information about them. Termination of the competition. If the Shisanyama Festival (PTY) needs to, because of legislative or regulatory reasons, we may terminate the competition immediately and without notice. If this happens you will not have any claim against the Shisanyama Festival (PTY), because of this.
